These Terms of Service ("Terms") govern your access to and use of the OWL (Operate with Lexite) plant operations software and related websites (the "Service") provided by LexitePH ("LexitePH", "we", "us" or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
OWL provides software for managing assets, work orders, preventive maintenance and related operations. We may add, change or remove features at any time.
2. Accounts
You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
3. Acceptable use
You agree not to misuse the Service, including by attempting to disrupt it, gain unauthorized access, infringe the rights of others, or use it for any unlawful purpose.
4. Subscriptions & billing
Paid plans are billed in advance on the cycle described at the time of purchase. Fees are stated exclusive of taxes unless noted otherwise. We may change pricing prospectively with reasonable notice.
5. Refunds
Refunds, where offered, are handled as described in our Refund Policy, which forms part of these Terms.
6. Your data
You retain ownership of the data you submit to the Service. You grant us the limited rights necessary to host and process that data in order to provide the Service. Our handling of personal information is described in our Privacy Policy.
7. Intellectual property
The Service, including its software, design and trademarks, is owned by LexitePH or its licensors and is protected by applicable laws. These Terms do not grant you any rights in the Service other than the limited right to use it as permitted here.
8. Availability & disclaimer of warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the maximum extent permitted by law, LexitePH will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three months preceding the claim.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if we reasonably consider it necessary to protect the Service or other users.
11. Changes to these Terms
We may update these Terms from time to time. Changes are effective when posted on this page. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
